EU Requests Comments on Proposed Regulations Covering Verification of CO2 Emissions Performance

On July 18, 2023, the European Commission published two new draft Regulations, one Supplementing Regulation and one Implementing Regulation, for public comment. These two draft Regulations set out guiding principles and criteria for defining the procedures for the verification of the CO2 emissions and fuel consumption values of in-service passenger cars and light commercial vehicles.

Both of these draft Regulations relate to Regulation (EU) 2019/631 which sets CO2 emission performance targets for new passenger cars and light commercial vehicles. Article 13 of (EU) 2019/631 specifies that, for all of the vehicle types which they are responsible for the type approval of, the Type Approval Authority must carry out testing on in-service vehicles of that vehicle type to verify that the CO2 emissions and fuel consumption performance of those in-service vehicles conform to the values recorded on their Certificates of Conformity. Additionally, the Type Approval Authorities are required to check these in-service vehicles for the presence of any strategies that artificially improve the vehicle's performance during type approval testing.

The two draft Regulations provide guidance to Type Approval Authorities on the criteria to be applied in the selection of in-service test vehicles and on the procedures to be followed when verifying the CO2 emissions and fuel consumption performance of in-service vehicles.

The closing date for interesting parties to submit comments to the European Commission on these draft Regulations, via the European Commission's 'Better Regulation' web site, is August 15, 2023.
