On May 21, 2025, the European Commission published a draft Regulation proposing amendments to EU Regulation (EU) 2023/1542 on batteries and waste batteries for public comment. Within (EU) 2023/1542, a number of battery due diligence obligations are specified, which companies placing batteries onto the market or into service must comply with. However, the mechanisms and processes required to verify compliance with these due diligence obligations are still under development, and it now appears unlikely that these will be in place to support the mandatory compliance dates specified within (EU) 2023/1542. Therefore, this draft Regulation proposes delaying the relevant mandatory compliance dates to allow time for the necessary mechanisms and processes for compliance assessment to be fully developed and implemented.

The closing date for interested parties to submit comments to the European Commission on this draft Regulation, via the European Commission's ‘Better Regulation’ web site, is July 31, 2025.

This draft Regulation is available on InterRegs.NET for our EC subscribers and is also available at Selectregs.com.
