NHTSA Provides Additional Opportunities for Public Contribution to Information Relating to ADS

In the March 9, 2021 Federal Register (Vol. 86 No. 44), NHTSA invites public comments regarding their intention to request approval from the Office of Management and Budget (OMB) for an extension of a currently-approved information collection on document "Automated Driving Systems 2.0: A Vision for Safety" [Docket No. NHTSA-2021-0013]. Before a Federal agency may collect certain information from the public, it must receive approval from OMB. Under procedures established by the Paperwork Reduction Act of 1995, before seeking OMB approval, Federal agencies must solicit public comment on proposed collections of information, including extensions and reinstatements of previously approved collections. Currently approved through May 31, 2021,the proposed extension is 3 years from date of approval. Comments must be submitted on or before May 10, 2021.

In the March 10, 2021 Federal Register (Vol. 86 No. 45) the National Highway Traffic Safety Administration (NHTSA) reopened the comment period for an Advance Notice of Proposed Rulemaking (ANPRM) that was published December 10, 2020. The ANPRM requested public comment on whether any test procedure for any Federal Motor Vehicle Safety Standards (FMVSS) may be a candidate for replacement, repeal, or modification, for reasons other than for considerations relevant only to ADS. Now reopened, the new comment period will end on April 9, 2021.

The ANPRM provided examples of test procedures found in FMVSS 103, 104, 105/135, 121, and 126 to facilitate responses. The ANPRM also asked commenters to provide research, evidence, and data to support why such change may be necessary. NHTSA received on January 14, 2021 a petition from the Alliance for Automotive Innovation (Auto Innovators) requesting a 30-day extension of the comment period to conduct a comprehensive review of the extensive number of regulations that contain detailed test procedures, including standards that reference industry standards.
